How Immigration Bonds Work
Immigration bonds follow federal rules, set by ICE or an immigration judge. Whether a bond is allowed depends on the case. Here is how the immigration bond process works.
An immigration bond is paid to ICE, part of the Department of Homeland Security, not a county court. It lets a detained person be released while their immigration case moves through the federal courts to a decision.
The most common type is a delivery bond, which ensures the person attends every immigration hearing. The minimum is fifteen hundred dollars, and amounts often run much higher depending on the case and the person’s history.
A voluntary departure bond lets a person leave the country on their own by a set date, instead of facing formal removal. The bond is refunded once they depart on time, as agreed with the court.
If ICE sets no bond or sets it too high, an immigration judge can hold a bond hearing to set or lower it. An immigration attorney can request this hearing and argue for a lower bond or release.
